Detailed information is provided here about how Alexia creative Liptov s.r.o. collects and processes personal data and the rights you have as a data subject so you know that your personal data are being fairly and transparently processed. By providing the information within the meaning of Art. 13 and 14 of Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”), you are aware of our information obligation towards you. The Privacy Policy is intended for all visitors and users of www.alexiacreativeliptov.sk (the “Website”). The data subjects whose personal data are processed at the Website and its subpages are visitors to the Website;

III. FROM WHERE DO WE COLLECT YOUR PERSONAL DATA?

You can usually visit the Website without having to provide us with information about your identity or revealing any information about yourself. For IT reasons, our web servers collect IP addresses to let you connect to our platform and provide you with our services. However, you are voluntarily entering your personal data when you fill out the registration form for services offered on the Website. We may also obtain your personal data from third parties, such as our business partners and organizations, anti-fraud agencies, sanctions lists or lists of politically exposed persons and public registers, where possible and legally permissible.

Normally 10 years from the date when the legal relationship is terminated, unless a specific regulation requires the retention of data for a longer period.

What are cookies? A cookie is a small file that is stored locally on your computer when you visit the Website. Cookies allow us to analyze the use of the Website. They do not include any personal data and you cannot be identified through them on third party websites. How are cookies used?   1. OBLIGATORY OR VOLUNTARY NATURE OF THE PERSONAL DATA REQUESTED FROM YOU

If the legal basis for processing of your personal data is compliance with our legal obligation under Article 6 (1) (c) of the GDPR and you refuse to provide us with your personal data, this may cause damage and lead to us seeking indemnification from you (e.g. to compensate for sanctions imposed upon us because of causal connection with failure to fulfil our own obligations). Were the legal basis for processing of your personal data the conclusion of a contractual relationship or performance of a contract and you refuse to provide us with your personal data, this might thwart a binding contractual and legal relationship with Alexia creative Liptov s.r.o. If the legal basis for the processing of your personal data is consent thereto pursuant to Article 6 (1) (a) of the GDPR, you may withdraw it at any time, and you are entitled to use the same method as you used to give us consent. Your granting of consent to the processing of personal data will never be made contingent on entering into a contractual relationship with us. If the legal basis for the processing of your personal data is overridden by our legitimate interests and we use the legal basis under Article 6 (1) (f) of the GDPR, you will be obliged to accept it, although you will still have the right to object. If the legal basis for the processing of your personal data is the performance of a task carried out in the public interest pursuant to Art. 6 (1) (e) of the GDPR, we will be entitled to process your personal data under the conditions set out herein.

VII. RECIPIENTS OF PERSONAL DATA

Recipients particularly include (i) outside companies providing internal system development and support services, hosting providers, data center service providers, and cloud service providers; (ii) delivery and courier service providers; (iv) law offices, courts or collection agencies seeking recovery of claims made by us against you should you fail to meet your obligations to Alexia creative Liptov s.r.o. and not respond positively to our offer of an out-of-court settlement. Other persons who come into contact with your personal data are persons employed by Alexia creative Liptov s.r.o. who are trained regularly in procedures for the lawful and secure processing of your personal data. All employees of Alexia creative Liptov s.r.o. have a legal obligation to keep your personal data confidential. For more information about our current recipients (including processors), please contact the Data Protection Coordinator at any time to request a list. In the case of processors, Alexia creative Liptov s.r.o. has elevated legal safeguards for the protection of your personal data, which have been put in place in a data processing agreement (DPA) concluded in accordance with Art. 28 (3) of the GDPR. Alexia creative Liptov s.r.o. is also obliged to disclose your personal data to public authorities entitled to receive them in the exercise of their powers vested in them under applicable special laws, such as police investigators, courts, and the Office for Personal Data Protection, even if they do not have the status of recipients within the meaning of the GDPR.

VIII. USE OF THE WEBSITE BY PERSONS AGE 16 OR UNDER

If you are under the age of 16, please ask your parents or other legal guardians for consent before providing us with any personal information. Unless they provide it, you will not be entitled to provide us with your personal data.

  1. TRANSFER TO THIRD COUNTRIES

No personal data will be transferred by us to any third country outside the EU/EEA. However, should there be data transferred to a third country outside the EU/EEA, you have our assurance of the adequate safeguards provided in Art. 44 et seq. of the GDPR. The European Commission considers some non-EEA countries to have provided substantially equivalent protection to EU data protection laws and so no additional safeguards are required for transfers of personal data to these jurisdictions (see http://ec.europa.eu/justice/data-protection/international-transfers/adequacy/index_en.htm for a full list). In countries that have not received such approval (e.g. Russia), Alexia creative Liptov s.r.o. will, where applicable, either require your consent to the transfer of your personal data or they will be transferred in accordance with standard contractual terms and conditions approved by the European Commission that impose the same data protection obligations directly upon the recipient, unless applicable data protection legislation permits the transfer without such formalities.

  1. PROFILING AND AUTOMATED DECISION MAKING

Neither Alexia creative Liptov s.r.o., nor any of its intermediaries, profiles data subjects or engages in automated decision-making.

  1. RIGHTS OF DATA SUBJECTS

As a data subject, you have the following rights under applicable data protection law: a) Right of access – you have the right to be provided with a copy of the personal data Alexia creative Liptov s.r.o. holds about you and information about how your personal data is used. In most cases, your personal data will be provided to you in written documentary form, unless you request otherwise. If you have requested this information electronically, it will be likewise provided to you electronically where technically possible.

  1. b) Right to rectification – reasonable steps are taken by us to ensure that the information we hold about you is accurate, complete and up to date. If you believe that the information we hold is inaccurate, incomplete or out of date, please do not hesitate to ask us to amend, update or supplement this information.
  2. c) Right to erasure – you have the right in certain circumstances to ask us to erase your personal data, for example if the personal data we have collected about you are no longer necessary to fulfill the original purpose of processing them or if you withdraw your consent to the processing thereof. However, your right has to be assessed in the light of all relevant circumstances. For example, Alexia creative Liptov s.r.o. may have certain legal and regulatory obligations, which means that we may not be able to comply with your request.
  3. d) Right to restrict processing – in certain circumstances you are entitled to ask us to stop using your personal information. For example, if you think that the personal information we hold about you may either be inaccurate or no longer needed by us.
  4. e) Right to data portability – you have the right in certain circumstances to ask us to transfer the personal data you have provided to us to another third party of your choice.
  5. f) Right to object – you have the right to object to the processing of your data based on our legitimate interests. If Alexia creative Liptov s.r.o. does not have a compelling legitimate reason for processing your personal data and you object thereto, we will not process your personal data any further.
  6. g) Rights relating to automated decision-making – you have the right to refuse automated decision-making, including profiling, of legal or similar significant consequence for you.
  7. h) Right to withdraw consent – where you have given your consent to the processing of your personal data, you have the right to withdraw it and prohibit the further use thereof.
  8. i) Right to lodge a complaint with a supervisory authority or seek judicial protection – you have the right as a data subject to lodge a complaint at any time with the Office for Personal Data Protection, which is the supervisory authority for Slovakia (more information can be found on the Website (en) or to bring an action before a competent court.

How and where to submit your application Any request for the exercise of your rights as a data subject under the GDPR may be (i) sent in a written and signed request to the address of the registered seat of Alexia creative Liptov s.r.o. for the attention of the Data Protection Coordinator; (ii) emailed with a to the address of Alexia creative Liptov s.r.o. with a qualified electronic signature; (iii) brought in person at the registered seat of Alexia creative Liptov s.r.o.; or (iv) made in any other way. This is without prejudice to your right to withdraw your consent to the processing of your personal data, which you can always do as easily as you gave it to us (e.g. if you gave your consent electronically, you can always email or apply for withdrawal without the need to send a written request to the registered seat of Alexia creative Liptov s.r.o.). It is recommended for each request that you explain in as much detail as possible what right you are exercising under the GDPR, what your data for verifying your identity are, and/or for what purposes and data your request references. Clarification would be needed if your request is overly general. We would like to point out that, when handling your request to exercise your right as a data subject under the GDPR and other applicable data protection legislation, you might be asked by us for reliable verification of your identity, in particular if you are requesting to exercise your right outside of a written and signed letter, by e-mail with a qualified electronic signature or in person at the registered seat of Alexia creative Liptov s.r.o. (for instance in cases of ordinary e-mail requests or telephone calls). How and when will your request be handled? Each request received by Alexia creative Liptov s.r.o. for a data subject’s exercise of his or her rights will be individually and competently assessed, and you will always be informed by us of the result within one (1) month of receipt of the request at the latest. The handling of a request related to the exercise of a data subject’s right under the GDPR and other applicable data protection legislation is free of charge. If your request is manifestly unfounded or unreasonable, in particular because it is repetitive, Alexia creative Liptov s.r.o. is entitled to charge a reasonable fee that takes into account the administrative costs involved in providing the requested information. If you repeatedly request copies of the personal data Alexia creative Liptov s.r.o. processes, we reserve the right to charge for this reason a reasonable fee for administrative costs. The GDPR sets out the general conditions for exercising your individual rights. However, their existence does not automatically imply that we will comply with them when you exercise your individual rights, as exceptions may apply in a particular case, or some rights are linked to specific conditions that may not be met in every case. Alexia creative Liptov s.r.o. will always deal with your request regarding a specific right and examine it in the light of legislation and its internal policy for handling complaints from data subjects. Should we fail to process your request for the exercise of your rights as a data subject under the GDPR, you have the option of lodging a complaint with the supervisory authority or seeking a judicial remedy directly with the competent court. If Alexia creative Liptov s.r.o. is not competent to consider your request, it will be forwarded at once to the relevant controller.

XII. CHANGE IN CONDITIONS

The information Alexia creative Liptov s.r.o. is required to provide you in relation to the processing of your personal data may change or cease to be up-to-date. Therefore, the privacy policy is regularly revised and updated. The current version is always available on the Website. This version was released on 16 March 2021

XIII. Processing of personal data for marketing purposes

I consent to the processing of my personal data, specifically my full name, e-mail address and telephone number, for the purpose of sending newsletters and alerts, surveys and other direct marketing communications related to the various services and products the Controller provides, and this for a period of five (5) years or until the withdrawal of my consent. I am aware of my right to withdraw this consent at any time, in whole or in part, by (i) emailing it to info@alexiacreativeliptov.sk or (ii) sending a written notice of withdrawal of consent to the address of the registered seat of Alexia creative Liptov s.r.o. This is without prejudice to the lawfulness of processing my personal data prior to the withdrawal of consent. XIV. I am over 16 years old

I confirm that I am over 16 years of age or, if not, that my legal representative has given consent to the processing of my personal data in connection with the Controller’s offering of goods and services.
